Criminal liability in driver negligence leading to death: A case study of Langkat district police jurisdiction

Abstract
Driver negligence resulting in death is a critical
issue within the realm of criminal law, raising important questions about the
extent of criminal responsibility and liability. In the jurisdiction of the
Langkat District Police, this issue has become increasingly relevant due to
rising incidents of fatal accidents caused by negligent driving behaviors such
as speeding, failure to yield, and distracted driving. This article examines
the legal implications and criminal responsibility for drivers whose negligent
actions lead to the death of others. It explores the legal framework under Indonesian
law, particularly the application of the Kitab Undang-Undang Hukum Pidana
(Criminal Code), and the standards for proving negligence in road traffic
incidents. The paper also addresses how Langkat District Police handle such
cases, considering both criminal investigations and prosecution strategies.
Through analysis of case studies, legal precedents, and the procedural approach
of local authorities, this study aims to provide a comprehensive understanding
of the balance between criminal liability and mitigating factors in negligent
driving cases. By evaluating current practices and challenges, the article
calls for clearer guidelines and more effective legal enforcement to ensure
justice for victims and deter future negligent behavior on the roads.
